Public Law 94-142, also known as the Individuals with Disabilities Act (IDEA) is legislation that was passed to ensure all students with disabilities ages 3-21 would receive a free and appropriate public education to meet their individual and unique learning needs.

Each child with a disability that impacts his/her education has a written document called and Individualized Education Plan or IEP.  The IEP developed for each student describes their educational program, in accordance with IDEA.  An IEP contains a student’s educational needs which prompt the writing of measurable goals and objectives that delegate the student’s appropriate program placement.  Also included in an IEP, are necessary related services like social work, occupational therapy, adaptive physical education and other itinerant services.

An IEP should contain information about the following:

  • Present levels of academic performance and progress
  • Goals and objectives that are obtainable and measurable
  • Related services
  • Explanation of non-participation in general education curriculum, if applicable
  • Student’s participation in statewide and district local assessments
  • Location and duration of the academic day spent in special education
  • Transportation services
  • Extended school year
  • Transition services (for students 14 ½  and older)

Kendall County Special Education Cooperative (KCSEC)
The Kendall County Special Education Cooperative is a Governing Board that provides special education services by joint agreement among the member districts:  Oswego, Yorkville, Plano, Newark, and Lisbon, while respecting geographic, socio-economic and cultural differences of each community. Partnerships with parents, business and industry, community resources, and have been developed to guarantee that special education students will learn the academic, vocational and social skills necessary to achieve to their individual potential in order to function as independent, productive adults in their homes and communities.

KCSEC and its member districts believe that all students can learn. Special education students are provided with equal access to regular education programs and facilities. Decisions regarding programs and placement are based on what is best for the student and provided within the local community whenever possible. Special education students are taught in the least restrictive environment by qualified staffs utilizing individualized methods and materials which reflect best practices. Diagnostic and support services are also available to students in a manner which is non discriminatory and recognizes the individual needs and differences of children, their families, culture, and the community in which they live.

The Special Education Referral Process
If a parent has concerns about their child’s academic or social emotional progress, as it relates to education, they should contact their child’s teacher and or building administration.  Each school building in the Oswego School District has a Pupil Personnel Services Team (PPST).  This team consists of diagnostic, educational, and administrative professionals that can help determined if a student is eligible to receive special education services. 

Continuum of Services
The Oswego School District offers special education services for students age 3 to 21.  Most special education services are cared for in the student’s home school.  In the event that a student’s needs may be more significant, they may attend school in one of the other Oswego District 308 school buildings or services may be contracted from outside of the district.  When a situation such as this presents itself, transportation can be provided for the student to attend the program agreed upon in the student’s IEP.
